This Policy is part of and governed by Artsi LLC’s Terms of Use. By using our Services, you agree to these terms.

Artsi is a website where artists, designers, and makers can sell their work. We make sure that the site is fair for everyone by taking intellectual property rights seriously. This Intellectual Property Policy explains how we deal with reports of copyright infringement, how others can report infringement of content on the site, and what Artsi sellers (“Vendors”) can do if their listings or shops are affected by a report.

1. Artsi's Role

A. Artsi is a marketplace where different Vendors can sell their products. These Vendors have their own shops, set their own rules, and are responsible for their own inventory and shipping. We provide a platform for these Vendors to use; Artsi does not produce any of the items sold on our site, nor do we stock any products or ship anything on behalf of our merchants.

B. Because of this, Artsi isn’t in a position to mediate copyright disputes between Vendors and potential other rights-holders. It’s up to the Vendor to make sure that they have the right to sell the item, and it’s up to the buyer to make sure that they’re not infringing on anyone’s copyright when they purchase an item.

C. If you think that someone is selling an item on Artsi that uses your copyrighted material, we encourage you to reach out to the Vendor directly. Both the Vendor’s shop and each product page have message forms that send directly to the Vendor so that you can easily get in touch with them.

D. If you’re unable to come to an agreement, or if you’d like to file a formal copyright infringement claim, you can follow the process below.

2. Artsi as a Venue

A. Artsi is a website where people can sell things and people can buy those things. As the operator of this marketplace, Artsi isn’t responsible for the content that our users upload. We have some basic rules that our users must follow, and we remove any content that violates these rules when we become aware of it.

B. People who use our site keep all the rights to the content they upload. This includes content that might violate someone else’s copyright. So, if someone uploads something to Artsi that uses your copyrighted material, Artsi isn’t liable for that infringement.

C. Even if we are not responsible for the infringement, we still do not allow content that infringes copyright. This is because we want to create a fair marketplace where everyone’s intellectual property rights are respected. If we become aware of listings or shops on Artsi that are infringing copyright, we will take action to remove them.

3. Reporting Copyright Infringement

If you believe that someone is selling an item on Artsi that infringes your copyright, you can report it to us.

Before you file a report, we ask that you consider contacting the Vendor directly to try to resolve the issue. If you’re unable to come to an agreement or if you’d like to file a formal claim, you can follow the process below.

A. Collect the following information:

  • The listing or shop URL
  • A description of the copyrighted work that you believe is being infringed
  • A description of where the infringing material is located on Artsi (for example, in the listing description, in the photos, or in the shop banner)
  • Your name, address, phone number, and email address
  • A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner
  • Your physical or electronic signature

Please note that we may not be able to take action on your report if it isn’t complete or if you don’t have all of the necessary information.

B. Send us this information to legal@artsi.ai, and we’ll investigate your claim. Please note that filing a false or abusive report may result in legal action taken against you.

4. Process for Dealing with Copyright Infringement Claims

A. When we receive a report of copyright infringement, we’ll send a notice to the Vendor stating that the material in question has been removed from Artsi because it infringes someone’s copyright. We’ll also provide the Vendor with your contact information so that they can reach out to you if they have any questions or want to resolve the issue directly.

B. If the Vendor believes that they have the right to sell the item, they can file a counter notice with us. A counter notice is a statement from the Vendor that they have the right to sell the item and that they consent to having the material reinstated on Artsi.

C. If we receive a counter notice, we’ll send you a copy of it and let you know that the material will be reinstated on Artsi in 14 days unless we receive notice from you that you’ve filed a court action to stop the reinstatement.

5. Counter-Notification Process

A. If you receive a notice that your listing or shop has been removed because of a copyright infringement claim, you may file a counter-notification with us. This lets us know that you have removed the infringing material and that you believe the removal was in error.

B. To file a counter-notification, you’ll need to send us the following information:

  • Your name, address, and phone number
  • The URL of the listing or shop that was removed
  • A statement by you, made under penalty of perjury, that you have a good faith belief that the material was removed in error
  • A statement that you consent to accept service of process (having legal papers served to you) from the person who submitted the original claim of copyright infringement or an agent of such person
  • A statement that you consent a complete copy of your counter notification be sent to the person who submitted the original claim of copyright infringement
  • Your physical or electronic signature

C. You can send this information to legal@artsi.ai. We’ll review your counter-notification and, if we determine it to be complete and valid, we’ll forward it to the copyright holder who submitted the original claim.

D. Please note that we may not be able to take action on your report if it isn’t complete or if you don’t have all of the necessary information.

E. The copyright holder will then have 14 days to notify us that they have filed a lawsuit against you. If we don’t receive such notification, we’ll restore your listing or shop to Artsi.

6. Repeat Infringers

Artsi is committed to protecting the intellectual property rights of others and expects our users to do the same. We respond to clear instances of copyright infringement, and terminate accounts of repeat infringers in appropriate circumstances.
